1. ABOUT THESE TERMS
1.1 Who we are. These Terms and Conditions ("Terms") are issued by Jobmerger Support Services Ltd, a company registered in England and Wales under company number 12142973, with its registered office at St. James House, Hollinswood Road, Central Park, Telford, England, TF2 9TZ ("Jobmerger", "we", "us", "our"). You can contact us at info@jobmerger.com for general enquiries, support@jobmerger.com for technical support and accounts@jobmerger.com for billing and account queries.
1.2 What these Terms cover. These Terms govern access to and use of our care management software, delivered through our web platform and our mobile application (together, the "Platform"), and the related onboarding, support and other services we provide (together with the Platform, the "Services").
1.3 Acceptance. By creating an account, starting a free trial, signing an Order or using the Services, you accept these Terms. If you accept them on behalf of an organisation, you confirm that you have authority to bind it, and "you" means that organisation.
1.4 Related documents. Our Privacy Policy, Cookie Policy, Mobile App Use Policy, Refund Policy and Copyright Notice also apply and are available on the Website. If an Order conflicts with these Terms, the Order prevails for that Subscription only, and only to the extent it expressly says so.
2. DEFINITIONS
2.1 Defined terms. In these Terms:
"Authorised User" means an individual whom a Customer permits to use the Platform under its Subscription, such as an employee, agency worker, contractor, family member or representative of a person receiving care.
"Business Customer" means a Customer that is a care provider, local authority, NHS body, charity, company or other organisation, or an individual acting for purposes relating to their trade, business, craft or profession.
"Customer" means the organisation or individual that holds a Subscription, including a Business Customer and an Individual Subscriber.
"Customer Data" means all data, including personal data, that a Customer or its Authorised Users submit to, or generate through, the Platform.
"Data Protection Law" means the UK GDPR, the Data Protection Act 2018 and the Privacy and Electronic Communications Regulations 2003, each as amended from time to time.
"Fees" means the fees for a Subscription shown at checkout, in our published price list or in an Order.
"Individual Subscriber" means an individual who takes out a Subscription for purposes wholly or mainly outside their trade, business, craft or profession, such as a family member arranging or overseeing care for a relative.
"Order" means an order form, quotation or proposal accepted by a Business Customer, or an online checkout completed by a Customer, that sets out the plan, Fees, number of Authorised Users and term.
"Subscription" means the right to access the Platform for a Subscription Period under an Order.
"Subscription Period" means the initial term stated in the Order and each renewal term.
"Website" means https://jobmerger.com and any related pages we operate.
2.2 Interpretation. Headings do not affect interpretation. "Including" means "including without limitation". References to legislation include it as amended or replaced.
3. THE PLATFORM
3.1 What the Platform does. The Platform helps care organisations and families plan, schedule, deliver and record care. Depending on the plan, it includes care plans and assessments, daily care notes, electronic medication administration records, rota and visit scheduling, electronic visit verification with check-in and check-out, staff records, secure messaging, family and representative access, reporting and invoicing tools.
3.2 Plans. Features, user limits and support levels vary by plan and are described on the Website or in the Order.
3.3 Changes to the Platform. We continuously improve the Platform and may add, change or withdraw features. We will not make a change during a Subscription Period that materially reduces the core functionality of a Customer's plan unless it is required by law, by security needs or by a third-party provider on which the feature depends. If such a change materially disadvantages you, you may end the affected Subscription and receive a pro rata refund of prepaid Fees for the unused period.
3.4 Mobile app. Use of our mobile app is also governed by our Mobile App Use Policy.
4. ELIGIBILITY AND ACCOUNTS
4.1 Age and location. You must be aged 18 or over to create an account or use the Platform. The Services are offered to Customers based in the United Kingdom.
4.2 Accurate information. You must give accurate and complete information when you register and keep it up to date.
4.3 Credentials. Each Authorised User must have their own log-in. Credentials must not be shared, and you must keep them confidential and tell us immediately at support@jobmerger.com if you suspect unauthorised access.
4.4 Sanctions and export. You confirm that you are not, and are not owned or controlled by, a person subject to sanctions imposed by the United Kingdom, and you must not access the Services from, or export them to, any country or person in breach of UK sanctions or export control law.
5. CUSTOMER ADMINISTRATORS AND AUTHORISED USERS
5.1 Administrators. A Business Customer must appoint at least one administrator, who controls the creation and removal of Authorised Users, their roles and permissions, and the features enabled for the Customer's account.
5.2 Responsibility for Authorised Users. The Customer is responsible for the acts and omissions of its Authorised Users and for ensuring they comply with these Terms and the Mobile App Use Policy.
5.3 Removing access. The Customer must remove access promptly when an Authorised User leaves or no longer needs it.
5.4 User limits. Use beyond the number of Authorised Users or service users purchased will be charged at the then-current rate for the Customer's plan from the date the limit was exceeded, and we will tell the Customer before charging.
6. FREE TRIALS
6.1 Trial terms. We may offer a free trial for the period and features stated when you sign up. These Terms apply during the trial.
6.2 Conversion. If you give payment details when starting a trial, your paid Subscription starts automatically when the trial ends unless you cancel before then. We will remind you by email at least three days before the trial ends, telling you the date on which charging will start, the amount and how to cancel.
6.3 No conversion without payment details. If you have not given payment details, your trial will end and access will be suspended until you choose a paid plan.
6.4 Trial data. Customer Data entered during a trial will be kept for 30 days after the trial ends and then deleted unless you take out a Subscription.
6.5 Trials are provided as is. Section 21.1 does not apply to a free trial, and the Services are provided during a trial without any service level commitment. Section 13 and our Privacy Policy apply in full during a trial.
7. SUBSCRIPTIONS AND ORDERS
7.1 Online subscriptions. When you subscribe online, the contract is formed when we confirm your Subscription by email.
7.2 Enterprise Orders. For Business Customers who contract by Order, the contract is formed when both parties sign the Order or when we confirm in writing our acceptance of an Order signed by the Customer.
7.3 Term and renewal. Each Subscription runs for the initial term stated in the Order and then renews automatically for successive periods of the same length unless either party gives notice under Section 9.
7.4 Plan changes. You may upgrade at any time and the higher Fees apply pro rata from the date of upgrade. Downgrades take effect at the start of the next Subscription Period.
8. FEES, BILLING AND TAXES
8.1 Fees. You must pay the Fees in accordance with the Order. Fees are stated in pounds sterling.
8.2 Online payment. Monthly and annual online Subscriptions are paid in advance by card or other payment method accepted at checkout, collected through our payment processor. You authorise us to charge your payment method at the start of each Subscription Period.
8.3 Invoiced payment. Where an Order provides for invoicing, invoices are payable within 30 days of the invoice date.
8.4 Taxes. Fees exclude VAT, which will be added at the applicable rate, unless the Order or checkout states otherwise. Prices shown to Individual Subscribers include VAT.
8.5 Late payment. If a Business Customer fails to pay an undisputed amount when due, we may charge interest under the Late Payment of Commercial Debts (Interest) Act 1998 and, after giving at least 14 days' written notice, suspend access until payment is made. We will not delete Customer Data because of late payment before the notice period in Section 20.2 has run.
8.6 Price changes. We may change the Fees for any renewal term by giving at least 30 days' notice before the renewal date. If you do not agree, you may cancel before the renewal takes effect.
8.7 Disputes. If you dispute an invoice in good faith, you must tell us within 30 days of the invoice date, giving reasons, and pay any undisputed part.
9. CANCELLATION, NON-RENEWAL AND REFUNDS
9.1 Online subscriptions. You can cancel an online Subscription at any time in your account settings or by emailing us. Cancellation stops the next renewal and your Subscription continues until the end of the current Subscription Period.
9.2 Enterprise Orders. Either party may prevent renewal of an Order by giving written notice at least 30 days before the end of the current Subscription Period, unless the Order states a different period.
9.3 Renewal reminders. For annual Subscriptions we will send a reminder at least 30 days before renewal, stating the renewal date, the price and how to cancel.
9.4 Refunds. Refunds are dealt with under our Refund Policy. Individual Subscribers have a legal right to cancel within 14 days, explained in Section 24 and in the Refund Policy.
10. CUSTOMER RESPONSIBILITIES AND REGULATORY COMPLIANCE
10.1 Professional responsibility. The Customer remains solely responsible for the care it provides, for its clinical and professional judgement, for staffing and safeguarding, and for meeting the requirements of the Care Quality Commission, the Care Inspectorate in Scotland, Care Inspectorate Wales, the Regulation and Quality Improvement Authority in Northern Ireland or any other regulator or commissioner that applies to it.
10.2 Accuracy of records. The Customer is responsible for the accuracy, completeness and timeliness of Customer Data, for reviewing records entered by its Authorised Users and for keeping an alternative means of accessing essential care information if the Platform becomes unavailable.
10.3 Lawful basis and transparency. The Customer is responsible for having a lawful basis for the Customer Data it collects, for providing privacy information to the people it supports and its staff, and for any data protection impact assessment required for its use of location, biometric or monitoring features.
10.4 Staff monitoring. Where the Customer enables location tracking, identity verification or other features that monitor Authorised Users, the Customer must tell them about the monitoring, use it proportionately and comply with employment and Data Protection Law.
10.5 Equipment. The Customer is responsible for the devices, connectivity and software needed to access the Platform, including keeping devices secure and up to date.
11. PROFESSIONAL AND CLINICAL DISCLAIMER
11.1 A record-keeping and workflow tool. The Platform is a tool for recording, organising and sharing care information. It does not provide medical, clinical, nursing, pharmaceutical, legal or employment advice, and it does not replace the judgement of qualified professionals.
11.2 Alerts and prompts. Alerts, reminders, prompts, templates and suggested allocations generated by the Platform are aids only. The Customer must not rely on them as the sole means of ensuring that care, medication or visits are delivered, and must keep its own procedures for missed visits, medication errors and emergencies.
11.3 Not a medical device. We have not designed the Platform for diagnosis, prevention, monitoring, treatment or alleviation of disease, and it must not be used for those purposes.
11.4 Emergencies. The Platform is not an emergency service. In an emergency, call 999 or the relevant emergency service.
12. ACCEPTABLE USE
12.1 Prohibited use. You must not, and must ensure that Authorised Users do not:
use the Services in breach of any law, including Data Protection Law, or of any duty of confidence owed to a person receiving care;
access records of individuals for any reason unconnected with their care or the Customer's legitimate business;
upload material that is unlawful, defamatory, discriminatory or that infringes another person's rights;
introduce viruses or harmful code, or attempt to probe, scan or test the vulnerability of the Platform without our written consent;
attempt to gain unauthorised access to the Platform, another Customer's data or our systems;
copy, modify, decompile, reverse engineer or create derivative works of the Platform, except to the extent the law expressly permits;
resell, sublicense or provide the Services to third parties outside the Customer's organisation, or use them to build a competing product; or
use automated means to extract data from the Platform other than through the export and integration features we provide.
12.2 Breach. We may remove material or suspend access in accordance with Section 19 if you or an Authorised User breach this Section.
13. CUSTOMER DATA AND DATA PROTECTION
13.1 Ownership. The Customer owns its Customer Data. The Customer grants us a non-exclusive licence to host, copy, process and display Customer Data only as needed to provide, secure and support the Services and as permitted by this Section.
13.2 Roles. For personal data within Customer Data, the Customer is the controller and we are its processor, except for Individual Subscribers, for whom we act as controller as described in our Privacy Policy. Sections 13.3 to 13.13 form the data processing terms required by Article 28 of the UK GDPR between us and each Business Customer.
13.3 Subject matter and details. The subject matter of processing is the provision of the Services for the Subscription Period. The nature and purpose of processing are hosting, storing, organising, retrieving, transmitting and displaying Customer Data so that the Customer can plan and record care and manage its workforce. The personal data includes identity and contact data, health and care data, medication data, location data, workforce data and, where enabled, biometric data. The data subjects are people receiving care, their families and representatives, and the Customer's staff and Authorised Users.
13.4 Instructions. We will process personal data only on the Customer's documented instructions, which are these Terms, the Order and the Customer's configuration and use of the Platform, unless the law requires otherwise, in which case we will tell the Customer before processing unless the law prohibits it. We will tell the Customer if we believe an instruction breaches Data Protection Law.
13.5 Confidentiality. Our personnel authorised to process personal data are bound by obligations of confidentiality.
13.6 Security. We will implement appropriate technical and organisational measures to protect personal data, as required by Article 32 of the UK GDPR, including encryption in transit and at rest, access controls, logging, backup and staff training.
13.7 Sub-processors. The Customer gives general authorisation for us to engage sub-processors. We will publish our current sub-processor list and give the Customer at least 30 days' notice of any new sub-processor. If the Customer objects on reasonable data protection grounds and we cannot resolve the objection, the Customer may end the affected Subscription and receive a pro rata refund of prepaid Fees. We will impose data protection obligations on each sub-processor that are no less protective than these Terms, and we remain liable for their performance.
13.8 International transfers. We will not transfer personal data outside the United Kingdom unless a transfer mechanism recognised under Data Protection Law is in place.
13.9 Assistance. Taking into account the nature of processing, we will assist the Customer by appropriate measures in responding to requests from data subjects, and in meeting its obligations relating to security, breach notification, data protection impact assessments and prior consultation with the Information Commissioner's Office. We may charge reasonable fees for assistance that goes beyond the Platform's standard functionality.
13.10 Personal data breaches. We will notify the Customer without undue delay, and in any event within 48 hours, after becoming aware of a personal data breach affecting Customer Data, with the information reasonably available to us, and we will keep the Customer updated.
13.11 Return and deletion. At the end of the Services, we will return and delete Customer Data in accordance with Section 20, unless the law requires us to keep it.
13.12 Information and audit. We will make available the information reasonably necessary to demonstrate our compliance with this Section, and allow for audits by the Customer or an independent auditor it appoints, on at least 30 days' notice, no more than once in any 12-month period unless required by a regulator or following a personal data breach, during business hours and subject to confidentiality.
13.13 Aggregated data. We may create aggregated and de-identified data from use of the Platform, from which no individual or Customer can be identified, and use it to operate, secure and improve the Services.
13.14 No training on Customer Data. We will not use identifiable Customer Data to train artificial intelligence models for purposes other than providing the Services to that Customer.
14. SECURITY, AVAILABILITY AND SUPPORT
14.1 Availability. We will use reasonable endeavours to make the Platform available 24 hours a day, seven days a week, except for planned maintenance, which we will try to carry out outside normal working hours with advance notice where practicable, and emergency maintenance.
14.2 Service levels. Any service level or service credit commitment applies only if it is set out in an Order. Service credits, where they apply, are the Customer's sole financial remedy for failure to meet the service level.
14.3 Support. We provide support through the channels and during the hours stated for your plan on the Website or in the Order.
14.4 Backups. We back up Customer Data regularly. Backups are for disaster recovery, and the Customer should use the export features to keep its own copies where its regulatory duties require.
15. THIRD-PARTY SERVICES AND INTEGRATIONS
15.1 Integrations. The Platform may allow the Customer to connect third-party services, such as payroll, accounting, health record, mapping or communication services. The Customer's use of a third-party service is governed by the provider's own terms.
15.2 Data flows. When the Customer enables an integration, it instructs us to exchange Customer Data with that service. We are not responsible for the third-party provider's handling of the data, its availability or its accuracy.
15.3 App stores and payment providers. Downloads through app stores and payments through our payment processor are also subject to those providers' terms.
16. INTELLECTUAL PROPERTY
16.1 Our rights. We and our licensors own all intellectual property rights in the Platform, the Website, our software, designs, templates, documentation, trade marks and the aggregated data described in Section 13.13. Our Copyright Notice gives further details.
16.2 Your licence. Subject to these Terms and payment of the Fees, we grant the Customer a non-exclusive, non-transferable right, for the Subscription Period, to permit its Authorised Users to use the Platform for the Customer's internal purposes of planning, delivering and recording care.
16.3 Templates. Care plan templates and other content we provide may be adapted by the Customer for its own use. The Customer is responsible for checking that any template is suitable for its service and regulatory requirements.
16.4 Reservation. All rights not expressly granted are reserved.
17. FEEDBACK
17.1 Use of feedback. If you give us suggestions or feedback about the Services, we may use it freely without any obligation to you, provided that we do not identify you or disclose your Confidential Information.
18. CONFIDENTIALITY
18.1 Obligation. Each party will keep confidential all non-public information it receives from the other that is marked as confidential or that a reasonable person would understand to be confidential, including Customer Data, pricing and our technology ("Confidential Information"), and use it only to perform or receive the Services.
18.2 Exceptions. The obligation does not apply to information that is or becomes public through no fault of the recipient, that the recipient already lawfully held, that it receives lawfully from a third party without restriction, or that it develops independently. A party may disclose Confidential Information where required by law or a regulator, giving the other party notice where lawful.
18.3 Duration. This Section continues for five years after the contract ends, and indefinitely for Customer Data and trade secrets.
19. SUSPENSION AND TERMINATION
19.1 Suspension. We may suspend access, in whole or in part, where reasonably necessary to prevent a security threat or harm to the Platform or others, where required by law, or where a Customer or Authorised User materially breaches Section 12. We will limit any suspension to what is necessary, give notice where practicable and restore access as soon as the reason has been resolved.
19.2 Termination for breach. Either party may terminate a Subscription immediately by written notice if the other materially breaches these Terms and, where the breach can be remedied, fails to remedy it within 30 days of written notice.
19.3 Termination for insolvency. Either party may terminate immediately by written notice if the other becomes insolvent, enters administration or liquidation (other than for a solvent reorganisation), has a receiver appointed or ceases to carry on business.
19.4 Effect. On termination, the right to use the Platform ends, subject to Section 20, and the Customer must pay all Fees due up to the termination date. If we terminate a Business Customer's Subscription under Section 19.2 or 19.3, Fees for the remainder of a committed Subscription Period become payable, unless the Order states otherwise. If the Customer terminates under Section 19.2, we will refund prepaid Fees for the unused period.
19.5 Survival. Sections 11, 13, 16, 18, 20, 21, 22, 23, 24 and 25 survive termination.
20. DATA EXPORT AND DELETION ON EXIT
20.1 Export. At any time during the Subscription Period the Customer may export Customer Data using the Platform's export tools in commonly used formats.
20.2 Post-termination window. For 30 days after the Subscription ends, we will keep Customer Data and, on request, give the Customer read-only access or an export of it. Exports beyond the Platform's standard tools may be charged at our standard rates.
20.3 Deletion. After that period we will delete Customer Data from the live Platform within a further 30 days, and from backups within the normal backup cycle, which does not exceed 90 days, unless the law requires us to keep it. On request, we will confirm deletion in writing.
20.4 Care records duties. The Customer is responsible for exporting and keeping any records it is required to retain after the Subscription ends.
21. WARRANTIES AND DISCLAIMERS
21.1 Our warranties. We warrant that we will provide the Services with reasonable care and skill and that the Platform will perform materially in accordance with its documentation. If it does not, we will at our option correct the problem or provide a workaround within a reasonable time, or, if we cannot, allow the Customer to terminate the affected Subscription and refund prepaid Fees for the unused period. This is the Business Customer's sole remedy for breach of this warranty.
21.2 Mutual warranties. Each party warrants that it has the power to enter into these Terms. The Customer warrants that it has the rights and permissions needed for us to process Customer Data under these Terms.
21.3 Disclaimer. Except as expressly stated in these Terms, and to the extent the law allows, all warranties, conditions and terms implied by law are excluded. We do not warrant that the Services will be uninterrupted or error-free, or that they will meet regulatory requirements specific to the Customer's service.
22. LIMITATION OF LIABILITY
22.1 Unlimited liability. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
22.2 Excluded losses. Subject to Section 22.1, neither party is liable to the other, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for loss of profits, revenue, business, contracts, goodwill or anticipated savings, or for any indirect or consequential loss.
22.3 Cap. Subject to Sections 22.1 and 22.4, each party's total liability arising under or in connection with these Terms in any 12-month period is limited to the Fees paid and payable by the Customer in the 12 months before the event giving rise to the claim.
22.4 Data protection cap. Subject to Section 22.1, our total liability for breach of Section 13 is limited to three times the amount in Section 22.3.
22.5 Payment obligations. The limits in this Section do not apply to the Customer's obligation to pay the Fees or to the indemnities in Section 23.
22.6 Data loss. Without affecting Section 13, our liability for loss or corruption of Customer Data caused by us is limited to restoring the data from the latest available backup.
22.7 Individual Subscribers. Section 24.3 applies instead of Sections 22.2 to 22.6 for Individual Subscribers.
23. INDEMNITIES
23.1 Our indemnity. We will defend a Business Customer against any third-party claim alleging that the Customer's authorised use of the Platform infringes that third party's UK intellectual property rights, and pay any damages finally awarded or agreed in settlement. If such a claim is made, we may procure the right for the Customer to continue using the Platform, modify it so that it does not infringe, or terminate the affected Subscription and refund prepaid Fees for the unused period. This indemnity does not apply to claims arising from Customer Data, third-party services or use in breach of these Terms.
23.2 Customer indemnity. A Business Customer will defend us against any third-party claim, including a regulatory claim, arising from Customer Data, the care the Customer provides, its breach of Section 10 or 12, or its instructions to us under Section 13, and pay any damages, fines and reasonable costs finally awarded or agreed in settlement, to the extent the law permits.
23.3 Conditions. The indemnified party must promptly notify the indemnifying party of the claim, allow it to control the defence and settlement, give reasonable cooperation at the indemnifying party's cost and make no admission without its consent.
24. INDIVIDUAL SUBSCRIBERS
24.1 Your statutory rights. If you are an Individual Subscriber, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015, including your right to services provided with reasonable care and skill and to digital content that is of satisfactory quality, fit for purpose and as described.
24.2 Right to cancel. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you may cancel your first Subscription within 14 days after the day the contract is formed without giving a reason. If you ask us to give you access during that period, you will pay a proportionate amount for the access provided up to cancellation. Our Refund Policy explains how to cancel and how refunds are made.
24.3 Our liability to you. We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for loss that is not foreseeable, or for business losses, because the Services are provided to you for domestic and private use. If defective digital content we supply damages a device or digital content belonging to you, we will repair the damage or pay you compensation.
24.4 Courts. If you live in Scotland or Northern Ireland, you may bring proceedings in the courts of your home nation, and the mandatory law of that nation applies to you.
25. GENERAL
25.1 Governing law and jurisdiction. These Terms and any dispute or claim arising from them, including non-contractual disputes, are governed by the law of England and Wales. Subject to Section 24.4, the courts of England and Wales have exclusive jurisdiction.
25.2 Dispute resolution. The parties will try to resolve any dispute through good faith discussion between senior representatives within 30 days of written notice of the dispute, before starting court proceedings. This does not prevent either party from seeking urgent relief.
25.3 Force majeure. Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, including failure of public networks, power failure, cyber attacks that could not have been prevented by reasonable security measures, pandemic, industrial action by third parties, war or government action, provided it gives prompt notice and uses reasonable efforts to mitigate. This does not excuse payment obligations. If the event continues for more than 60 days, either party may terminate the affected Subscription on written notice.
25.4 Changes to these Terms. We may update these Terms to reflect changes in the law, our Services or our business. We will give at least 30 days' notice of any material change by email or through the Platform. Changes will apply from the start of the next Subscription Period, unless they are required by law or do not disadvantage you. If you do not agree to a change, you may end your Subscription before it takes effect. Terms agreed in a signed Order cannot be changed without both parties' written agreement.
25.5 Assignment. The Customer may not assign or transfer its rights under these Terms without our prior written consent, which will not be unreasonably withheld. We may transfer our rights and obligations to a successor to all or part of our business, provided that this does not reduce the protection given to Customer Data, and we will tell you if we do so.
25.6 Subcontracting. We may subcontract parts of the Services, subject to Section 13.7, and remain responsible for our subcontractors.
25.7 Entire agreement. These Terms and any Order are the entire agreement between the parties about their subject matter. Each party acknowledges that it has not relied on any statement not set out in them. Nothing in this Section limits liability for fraud.
25.8 Severability. If any provision is found to be invalid or unenforceable, it will be modified to the minimum extent necessary, and the rest of these Terms will continue in force.
25.9 Waiver. A delay or failure to exercise a right is not a waiver of it.
25.10 Third-party rights. No one other than the parties has any right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
25.11 Notices. Notices to us must be sent to info@jobmerger.com or to our registered office. Notices to a Customer will be sent to the email address on its account or in the Order. Email notices are deemed received on the next business day after sending.
25.12 Publicity. We will not use a Business Customer's name or logo in marketing without its prior written consent.
25.13 Contact. Questions about these Terms should be sent to info@jobmerger.com. Technical support is available at support@jobmerger.com, and billing and account queries should be sent to accounts@jobmerger.com.
